Terms of Service

These Terms of Service ("Terms") form a legal agreement between you and SnapJoy Co., Limited ("SnapJoy", "Company", "we", "us", or "our"). These Terms govern your access to and use of our mobile games, applications, websites, customer support, online features, content, updates, and related services (collectively, the "Services").
These Terms are intended for mobile applications and games published by SnapJoy Co., Limited through our Apple developer account and for related SnapJoy services. They are not limited to any single app title. References to an "App" or "Game" mean any mobile application or game published or operated by SnapJoy Co., Limited.
By downloading, installing, accessing, or using any part of the Services, you agree to these Terms. If you do not agree, do not download, install, access, or use the Services.

2. Eligibility
You may use the Services only if you can enter into a binding agreement under applicable law. If you are under the age of legal majority in your location, you may use the Services only with permission and supervision from your parent or legal guardian.
If you allow a minor to use the Services, you are responsible for that minor's use of the Services, including any purchases, account activity, and compliance with these Terms.
3. License to Use the Services
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, access, and use the Services for your personal, non-commercial entertainment purposes.
You do not acquire ownership of the Services, any content in the Services, any account, any game progress, or any virtual items. We and our licensors reserve all rights not expressly granted to you.
4. Apple App Store Terms
If you download an App from the Apple App Store, your use of the App is also subject to Apple's applicable terms, including the Apple Media Services Terms and Conditions.
Apple is not a party to these Terms and is not responsible for the Services, support, maintenance, claims, or liabilities relating to the Services, except as required by applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.
5. Accounts and Game Progress
Some Services may allow or require accounts, device-based progress, cloud saves, platform accounts, or other identifiers to operate certain features. You are responsible for maintaining the security of any account credentials and for all activity under your account or device.
We may suspend, limit, reset, or terminate access to accounts, game progress, or Services if we reasonably believe that you have violated these Terms, engaged in fraud, cheating, abuse, illegal activity, or behavior that harms the Services or other users.
We are not responsible for lost progress, account access, virtual items, or data caused by device changes, uninstalling an App, platform changes, third-party service issues, user error, or termination in accordance with these Terms.
6. Acceptable Use
You agree that you will not:
- use the Services for any commercial purpose without our written permission;
- copy, modify, distribute, sell, lease, sublicense, or exploit the Services or any part of them;
- reverse engineer, decompile, disassemble, derive source code from, or create derivative works based on the Services, except where applicable law expressly permits it;
- bypass, disable, or interfere with security, access control, anti-cheat, payment, or technical protection measures;
- use bots, automation, scripts, scraping, data mining, or other unauthorized tools to access or interact with the Services;
- cheat, exploit bugs, manipulate gameplay, interfere with fair play, or disrupt the experience of other users;
- harass, threaten, abuse, defame, impersonate, or harm any person;
- upload, transmit, or make available unlawful, offensive, infringing, fraudulent, harmful, or malicious content;
- collect, disclose, or misuse personal information of other users;
- use the Services in violation of applicable law, platform rules, or these Terms.
7. User Content and Feedback
Some Services may allow you to submit content, feedback, reviews, messages, names, images, or other materials ("User Content"). You are responsible for your User Content and must ensure that you have all necessary rights to submit it.
By submitting User Content through the Services or to us, you grant SnapJoy a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform that User Content for operating, improving, marketing, and supporting the Services.
We may remove, moderate, or refuse User Content at any time where we believe it violates these Terms, applicable law, platform rules, or the rights or safety of others. We do not endorse User Content and are not responsible for User Content submitted by users.
8. Intellectual Property
The Services, including software, artwork, graphics, characters, names, logos, gameplay elements, text, sounds, music, audiovisual content, designs, features, and all related intellectual property rights, are owned by SnapJoy or our licensors.
You may not use our names, logos, trademarks, service marks, trade names, or other brand features without our prior written permission.
9. Virtual Items and In-App Purchases
The Services may include virtual currency, coins, points, boosters, lives, levels, subscriptions, premium features, cosmetics, or other digital items or content ("Virtual Items").
Virtual Items are licensed, not sold. They have no cash value, do not represent stored value, and cannot be exchanged for money, goods, services, or value outside the Services. You may not sell, transfer, trade, sublicense, or redeem Virtual Items except as expressly allowed within the Services.
We may manage, modify, replace, suspend, remove, or discontinue Virtual Items, the Services, or any feature at any time, subject to applicable law and platform requirements.
Payments for in-app purchases are processed by Apple or the applicable platform provider, not directly by SnapJoy. Refunds, billing issues, purchase history, and payment methods are generally handled by Apple or the applicable platform provider under their own policies. To request a refund for an Apple App Store purchase, you should follow Apple's refund process.
Except where required by applicable law or platform rules, all purchases are final and non-refundable.
10. Subscriptions
Some Services may offer auto-renewing subscriptions. Subscription terms, pricing, billing period, renewal, cancellation, and trial details will be presented in the App or through the Apple App Store before purchase.
If you purchase an auto-renewing subscription through Apple, your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current period. You can manage or cancel subscriptions through your Apple account settings. Deleting an App does not automatically cancel a subscription.
11. Third-Party Services and Advertising
The Services may include third-party advertisements, analytics, attribution, platform features, payment processing, links, content, or services. Third-party services are governed by their own terms and privacy policies.
We are not responsible for third-party services, including their content, availability, security, accuracy, billing practices, or privacy practices.
12. Privacy
Your use of the Services is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect information.
13. Updates, Changes, and Availability
We may update, modify, suspend, or discontinue any part of the Services at any time. Updates may be required for continued use of the Services.
We do not guarantee that the Services will always be available, uninterrupted, secure, compatible with every device, or free of errors. Some features may depend on internet access, device compatibility, platform services, or third-party providers.
14. Termination
These Terms remain in effect until terminated by you or us.
You may stop using the Services at any time by uninstalling the App and discontinuing access to the Services. We may suspend or terminate your access to the Services at any time if we reasonably believe that you violated these Terms, created risk or legal exposure, infringed rights, engaged in fraud, cheating, abuse, or unlawful activity, or harmed the Services or other users.
Upon termination, the license granted to you under these Terms ends immediately. Sections that by their nature should survive termination will survive, including provisions on ownership, Virtual Items, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.
15. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory.
We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted use, accuracy, reliability, availability, security, and error-free operation.
Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by applicable law, SnapJoy, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, device failure, service interruption, or loss of virtual items, arising out of or relating to the Services or these Terms.
To the fullest extent permitted by applicable law, our total liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of: (a) the amount you paid to us for the relevant Service during the three months before the claim arose; or (b) USD 10.
Nothing in these Terms limits liability that cannot be limited under applicable law.
17. Indemnity
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless SnapJoy, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against claims, losses, liabilities, damages, costs, and expenses arising out of or relating to:
- your use or misuse of the Services;
- your violation of these Terms;
- your User Content;
- your violation of applicable law or third-party rights;
- activity under your account, device, or credentials.
18. Intellectual Property Complaints
If you believe content in the Services infringes your intellectual property rights, please contact us at apple-hk-publisher@snapjoy.cc with:
- your name and contact information;
- identification of the work or right you claim has been infringed;
- identification of the material you believe is infringing;
- a statement that you have a good-faith belief that the use is not authorized;
- a statement that the information in your notice is accurate and that you are authorized to act on behalf of the rights owner.
We may remove or disable access to allegedly infringing material and may terminate repeat infringers where appropriate.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of Hong Kong, without regard to conflict of law principles, except where applicable consumer protection laws require otherwise.
Subject to applicable law, you and SnapJoy agree that disputes arising out of or relating to these Terms or the Services will be submitted to the competent courts of Hong Kong. Nothing in this section prevents either party from seeking injunctive or equitable relief for intellectual property misuse, unauthorized access, or misuse of the Services.
20. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date above. If changes are material, we may provide additional notice as required by applicable law or platform rules.
Your continued use of the Services after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
21. Miscellaneous
These Terms, together with any additional terms presented in a specific App or feature, form the entire agreement between you and SnapJoy regarding the Services.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision does not waive our right to enforce it later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations where permitted by law, including in connection with a merger, acquisition, reorganization, or sale of assets.
